General Terms and Conditions

These General Terms and Conditions (hereinafter: GTC) govern all legal relationships arising from the provision of healthcare or aesthetic services between Dunaderm Clinic Limited Liability Company (Registered Office: 1085 Budapest, Horánszky utca 10., Ground Floor, Door No. 3.; Company Registration Number: 01-09-422897; Tax Number: 32414457-2-42; represented by: Dr. Gergő Tóth, Managing Director with sole signing authority), as a clinic providing private healthcare and aesthetic services (hereinafter: Clinic), and the client using the services (hereinafter: Patient). The Clinic and the Patient are hereinafter collectively referred to as the Parties. Unless otherwise agreed in writing, the provisions of these GTC shall apply to all legal relationships related to the provision of healthcare/aesthetic services established – either orally, in writing, or through implied conduct – between the Parties (hereinafter: Service Agreement).

The provisions of these GTC apply to all services provided by the Clinic, regardless of whether the Patient’s care/treatment is carried out by the Clinic’s staff or its associates.

Patients intending to use the Clinic’s services are kindly requested to carefully read these GTC. Should you have any questions, please do not hesitate to contact the Clinic.

We hereby inform our esteemed Patients that the provisions of these GTC have been drafted to ensure that the Clinic’s healthcare services are provided in a manner that is reassuring to all Patients and to offer detailed information about the Clinic’s operations.

If the provisions of the Clinic’s GTC are amended, the Clinic will publish a notification on its website and make the revised consolidated version of the GTC available online at dunadermclinic.com. The Clinic states that the provisions of the modified GTC shall apply to all Patients.

2. Scope and General Provisions of the GTC

2.1. The effective date of this GTC: June 3, 2024.
2.2. This GTC applies to all services provided by the Clinic, including but not limited to aesthetic treatments and medical aesthetic procedures.
2.3. The Clinic provides its services with the due care expected, adhering to professional standards and prioritizing the health and other interests of the Patient.
2.4. By signing the individual Service Agreement, the Patient acknowledges and accepts the content of this GTC. If the Service Agreement is not formalized in writing, the Patient agrees to be bound by the GTC through their signed consent form or general informational acknowledgment for the treatment.
2.5. The Clinic informs Patients that it operates in full compliance with current legal, professional, and ethical regulations and possesses all necessary permits for its activities.
2.6. The Clinic provides health care/aesthetic treatments based exclusively on information provided by the Patient, as well as tests required by laws and professional regulations. The Clinic cannot be held responsible for complications arising from undisclosed information, congenital or hereditary conditions, or other unknown diseases that could only have been diagnosed through tests not mandated by law or professional regulations.
2.7. The Clinic informs Patients that all medical procedures/treatments involve risks. However, the physician/aesthetic specialist providing the Service will inform the Patient of these risks with the due diligence expected.
2.8. The Clinic is under no obligation to enter into or maintain a contract with Patients. Accordingly, the Clinic reserves the right to terminate or withdraw from the Service Agreement at any time.

3. Payment for Services

3.1. The Clinic informs Patients that it performs private healthcare and aesthetic procedures. Accordingly, its services are not covered by the social security system and are provided on a fee-for-service basis.
3.2. The current indicative price list for services is available at the Clinic’s reception, and the Clinic also provides pricing information based on the current price list or individual quotes via personal consultation, phone, or email.
3.3. Service fees include the cost of materials used during the Service but do not cover the price of medications or medical devices required for at-home follow-up care.
3.4. The Patient is required to pay the service fee immediately after the care is provided, either in cash or by card in Hungarian forints.
3.5. For a series of treatments, unless otherwise agreed by the Parties, the Patient must pay the fee in three installments.
3.6. The Patient acknowledges that service fees must always be paid directly to the Clinic. The Patient has no payment obligations toward the Clinic’s physicians or aesthetic specialists.
3.7. If the Patient cancels an appointment under conditions not specified in this GTC, the Clinic reserves the right to charge a no-show fee of HUF 10,000.
3.8. In the event of payment delays, the Clinic reserves the right to withhold services until the Patient settles their outstanding balance.
3.9. The Clinic reserves the right to unilaterally modify its fees. Fee changes and the updated price list must be posted at the reception before the changes take effect. Fee changes do not apply to Services already ordered under an existing Service Agreement.
3.10. The Patient acknowledges that the Clinic may enforce overdue debts through payment notices, legal action, or enforcement proceedings.

4. Contract for Services Provided by the Clinic

4.1. The Clinic provides its services under the terms set out in the individual Service Agreement and this GTC.
4.2. Patients may receive healthcare/aesthetic treatments from the Clinic of their own volition.
4.3. The legal relationship between the Parties extends from the commencement of the Service by the Clinic (unless otherwise stated in the Service Agreement) to its completion. Services are subject to the terms of the current and valid GTC, with any deviations specified in the individual Service Agreement.
4.4. The Clinic informs Patients that Services are only available through prior phone or online appointment scheduling. Due to the nature of the Services, delays in the scheduled start time may occur. If the delay is expected to exceed 30 minutes, the Clinic will offer a new appointment to Patients unwilling to wait.
4.5. By using the healthcare Service, the Patient acknowledges that the Clinic may involve subcontractors whose activities are the responsibility of the Clinic.
4.6. By signing the Service Agreement, the Patient explicitly acknowledges that all medical interventions and services provided by the Clinic carry risks. The Patient assumes the risks that may arise despite the professional and diligent conduct of the Clinic or its subcontractors. The Clinic notes that recovery processes are unique to each Patient, and recovery timelines can only be generally estimated by the attending physician or the Clinic.
4.7. The Clinic and the Patient may only amend the Service Agreement by mutual consent and in writing. Statements related to the agreement must also be made in writing unless the law or this GTC allows for oral declarations.
4.8. Any external circumstance beyond the Clinic’s control that was unforeseeable at the time of entering the Service Agreement and which negatively impacts its performance is considered force majeure. Force majeure events do not constitute a breach of contract and do not entitle the Patient to file a claim for damages.

5. Conditions for Accessing the Services Provided by the Clinic

5.1 General Information

5.2 Appointment Booking and Service Agreement

a) An appointment becomes valid upon verbal or written confirmation by the Clinic. During confirmation, the Clinic informs the patient—or a third party acting on the patient’s behalf—about cancellation policies and rules regarding lateness.

b) If a patient arrives late for a scheduled appointment but within 15 minutes, the Clinic may still perform the agreed-upon treatment/examination during the session. However, the Clinic may decide not to proceed if it believes this would jeopardize timely care for other patients. For delays exceeding 15 minutes, the Clinic will offer a new appointment to ensure other patients’ services are unaffected. In such cases, the patient is not entitled to any compensation.

c) A new appointment must be scheduled before every visit.

d) Patients must complete necessary data registration and declarations—such as consent for data processing and acceptance of these terms—on-site at the Clinic’s reception or with the attending physician/aesthetic specialist before treatment.

e) Prior to any treatment, the patient must review, sign, and accept a detailed written quote (referred to as the “Declaration of Quote Acceptance”).

f) Services can only commence once the patient has accepted and signed the declarations outlined in sections e) and f).

g) The Service Agreement can be signed by the patient or their legal representative.

h) In the absence of a signed Service Agreement, any verbal or written statement or implied action—such as utilizing a healthcare service, paying a deposit, or scheduling an appointment—constitutes a valid service request.

i) Patients and their companions must adhere to the Clinic’s house rules.

j) For medical services, the Clinic records an outpatient report on the patient’s health status, documenting it in the EESZT system in compliance with legal regulations.

5.3 Cancellation Policy

a) Patients may cancel scheduled appointments up to 24 hours before the intended start time. Failure to do so will result in a no-show fee as specified in these terms.

b) The Clinic emphasizes that laser hair removal treatments for intimate areas cannot be performed during menstruation. Patients are requested to avoid scheduling appointments during this time. If menstruation unexpectedly begins, patients are advised to cancel their appointments promptly.

5.4 Termination of the Service Agreement

The Service Agreement may be terminated under the following conditions:
a) By mutual agreement of both parties.
b) If the Clinic ceases to exist without a legal successor.
c) If the Clinic’s operating license is revoked.
d) By ordinary termination.
e) By immediate termination.
f) Upon fulfillment of the contract.
g) In the event of the patient’s death.

5.5 The patient may terminate the Service Agreement at any time with immediate effect. However, they remain liable for payment for any services already provided by the Clinic.


6. Patient Rights

6.1 Right to Self-Determination

i. Patients have the right to:
a) Decide whether to use the Clinic’s services and to consent to or refuse specific treatments. For refused services, the Clinic is entitled to request payment for already provided services.
b) Make decisions regarding examinations and treatments. If no written Service Agreement is signed, medical examinations, handed-over medical documents, or signed invoices will be considered as consent for examination and treatment.

ii. If a patient refuses or unjustifiably withdraws consent for necessary treatment despite being informed under the Service Agreement:
a) They must compensate the Clinic for any resulting damages, costs, or expenses.
b) The Clinic may withdraw from the contract.
c) The patient assumes responsibility for any health consequences resulting from their decision.

iii. If a patient fails to attend follow-up appointments, report complications to the Clinic promptly, or refuses recommended procedures or diagnostics, they bear full responsibility for any resulting consequences and risks.

6.2 Right to Access Documentation

6.2.1 The Clinic maintains healthcare documentation regarding the patient’s personal data, medical history, and services provided.
6.2.2 Patients have the right to review their documentation, request summaries, or obtain copies. Patients retain ownership of the documentation and its data.
6.2.3 The Clinic may share patient data with third parties without consent if required by law or necessary to protect others’ lives, physical safety, or health.

6.3 Right to Information

6.3.1 Patients may ask questions, make observations, and receive all necessary information regarding their treatment.
6.3.2 By signing the Service Agreement, or in its absence, a consent form acknowledging risks, patients confirm they have received all relevant information regarding:
a) Their health status and medical evaluation.
b) Proposed examinations and treatments.
c) Potential benefits and risks of proceeding with or skipping treatments.
d) Scheduled times for procedures.
e) Decision-making rights regarding proposed treatments.
f) Alternative procedures or methods.
g) The treatment process and expected outcomes.
h) Additional care.
i) Recommended lifestyle changes.

6.4 Right to Choose

6.4.1 Patients may choose their attending physician or aesthetic specialist affiliated with the Clinic.
6.4.2 The Clinic reserves the right to assign another professional in unforeseen circumstances while ensuring appropriate care is provided.

7. Obligations of the Patient
7.1. The Patient is required to cooperate with the Clinic, which includes disclosing their medical history, health condition, intolerances, and contraindications with reasonable detail and due diligence, particularly focusing on the following:
a) past illnesses, treatments, medication or health products taken, and health risk factors,
b) any condition that may endanger the lives or physical safety of others, particularly infectious diseases and conditions that disqualify the performance of certain activities,
c) any legal declarations previously made related to healthcare.

7.2. The Patient is required to follow the rules for aftercare at home and attend scheduled follow-up appointments after the Service has been provided.

7.3. The Clinic informs Patients that they must adhere to the Clinic’s internal regulations and operational rules while on the premises and refrain from any behavior that could endanger the health or tranquility of others. If this rule is violated, the Clinic reserves the right to terminate the Service Agreement with immediate effect and claim compensation for the completed Services and any resulting damages.

7.4. The Patient must respect the rights of other patients and the Clinic’s staff.

7.5. If any of the obligations outlined in Section 7 are breached, the Patient is obligated to fully compensate the Clinic for any resulting damages and for any reasonable and documented expenses incurred. Additionally, the Clinic reserves the right to terminate the Service Agreement with immediate effect.


8. Submitting Complaints to the Clinic
8.1. Any complaints related to the Services provided by the Clinic can only be submitted in writing. Patients are requested to submit their complaints via mail to the Clinic’s headquarters or via email. Complaints will only be accepted if submitted by the Patient or their legal representative.

8.2. The Clinic reviews and resolves all complaints within 15 (fifteen) days of receipt and informs the Patient of its position regarding the complaint.

9. Data Protection, Data Processing, Confidentiality
9.1. The Patient and the Clinic handle information obtained during the Service in accordance with Act CXII of 2011 on the Right of Informational Self-Determination and Freedom of Information (Info. Act) and Regulation (EU) 2016/679 of the European Parliament and Council (General Data Protection Regulation or GDPR).

9.2. The Patient provides the following data to the Clinic: full name, birth name, place and date of birth, mother’s name, address, phone number, and email address. For entering into the Service Agreement, the Patient must present their health insurance card (for medical treatment only), identification document (ID card, passport, or driver’s license), and address card. If the Patient does not have a valid health insurance card, their medical documentation will not be recorded in the National eHealth Infrastructure (EESZT).

9.3. By signing the Service Agreement—or, in its absence, the data management declaration—the Patient consents to providing the information listed in Section 9.2, along with any other health or personal data necessary to fulfill the Service Agreement. The Patient also consents to the disclosure of such data to the Clinic’s associates and subcontractors involved in the Services. The Clinic commits to publishing a list of such associates on its website in its Privacy Policy.

9.4. The Clinic processes data solely based on the Patient’s prior written consent.

9.5. The Clinic notes that health-related information about the Patient cannot be disclosed via telephone unless identity verification has been conducted. The Patient acknowledges that the Clinic will forward medical examination results and information to the attending physician, who is authorized to provide explanations to the Patient.

9.6. The Patient agrees to keep confidential any information regarding the Clinic’s operations obtained during the Service and not to disclose it to third parties, authorities, or courts without the Clinic’s consent, unless required by law. This confidentiality obligation remains in effect even after the termination or fulfillment of the Service Agreement.


10. Final Provisions
10.1. The Clinic reserves the right to unilaterally amend this General Terms and Conditions (GTC) at any time. The amended GTC will be published in a consolidated format on the Clinic’s website, and this fact will be recorded on the website. Amendments to the GTC do not affect previously concluded Service Agreements.

10.2. The Parties agree to attempt to resolve any disputes arising from the provisions of this GTC or the Service amicably.
